Sitter Agreement

General terms for the Sitter Agreement between sitters and owners booked via Petbnb

Effective from: 25 September 2026

Pet Matters B.V. (hereinafter: Petbnb) operates the Petbnb platform and app (hereinafter: the platform). Through this platform, a private owner (hereinafter: the owner) can book a private sitter or dog walker on a flexible basis (hereinafter: the sitter). The Sitter Agreement falls under the Regeling Dienstverlening aan Huis (Dutch domestic services arrangement) where its statutory conditions are met. By flexible we mean: occasional, without a fixed character, not occurring systematically, incidental. A recurring schedule may affect whether those conditions are met. The owner is expressly referred to the information on the platform about the Regeling Dienstverlening aan Huis and is expected to assess whether the arrangement applies to the services they book. Any consequences of the arrangement not applying are for the owner's own account and risk. Petbnb does not provide pet-care services itself; it facilitates agreements between owners and sitters through its platform.

Petbnb is not a party to the Sitter Agreement and is not the sitter’s employer. Petbnb does not provide pet-sitting or dog-walking services itself. Sitters set their own availability, prices and conditions within the platform’s options and decide whether to accept or decline a request, booking, recurring schedule or change proposal.

The owner and the sitter in principle enter into two agreements: firstly an agreement with Petbnb on the use of the platform (hereinafter: the User Agreement). Secondly, the agreement for the performance of the services between the owner and the sitter (hereinafter: the Sitter Agreement). The following General Terms of the Sitter Agreement (hereinafter: GT Sitter Agreement) apply to this Sitter Agreement between the owner and a sitter.

1. Formation of the Sitter Agreement

1.1 The Sitter Agreement between the owner and the sitter falls under the Regeling Dienstverlening aan Huis where its statutory conditions are met; the parties to the agreement are only the owner and the sitter. Petbnb facilitates their contact, Reservation, payment and communication, but does not provide the care and is not a party to the Sitter Agreement. The owner has a claim against the sitter for performance of the services set out in the booking request. The sitter has a claim against the owner for payment of the stated fee, including 8% holiday pay per year, sick leave and compensation for statutory holiday days accrued by the sitter under the Regeling Dienstverlening aan Huis, in so far as those entitlements apply.

1.2 A Reservation only exists once payment through Petbnb has been completed and the booking has been confirmed. Acceptance of an Offer before payment is not a Reservation. Where the sitter can select a cancellation policy, the sitter-selected policy is binding from confirmation of the Reservation.

1.3 The Sitter Agreement only begins when the booked care actually starts. It applies to the service, period and price confirmed and paid through Petbnb between the owner and the sitter. After completion of the service, the owner can leave a review for the sitter.

1.4 Sitters may, on request, provide the owner with a passport, driving licence and/or a Certificate of Good Conduct (VOG).

1.5 Petbnb currently accepts only private individuals offering pet-care services in a private capacity. Businesses and individuals acting in the course of a trade, business or profession, or on behalf of a business, are not eligible to offer services on the Platform.

1.6 By submitting a Sitter Listing or Offer, the sitter expressly declares that they act as a private individual and not as a professional or business provider. The sitter must provide accurate identification and status information, promptly notify Petbnb of any change and stop accepting new bookings if they no longer meet this requirement. Petbnb may request supporting information and refuse or restrict access where the declaration is inaccurate or the sitter is ineligible. The declaration does not override the sitter's actual legal status or obligations.

1.7 Each sitter must comply with the tax laws applicable in their country of residence and any country where they provide services, including declaring income and paying any taxes due. The sitter must provide accurate and current identification and tax information reasonably required for Petbnb's legal reporting obligations, including DAC7 where applicable. Acting as a private sitter does not exempt the sitter from tax obligations.

2. Subject of the Sitter Agreement

2.1 The services under this agreement consist of the sitting and dog-walking services booked by the owner via Petbnb and accepted by the sitter.

2.2 In performing the Sitter Agreement, the sitter is not subject to instructions from Petbnb. The owner may give instructions in so far as these fit within the scope of the Sitter Agreement. The sitter performs the Sitter Agreement, taking into account the owner's instructions, on the sitter's own organisation and responsibility, having regard to the provisions of the Sitter Agreement.

2.3 The owner provides the sitter with the information and assistance necessary for the effective and efficient performance of the services, so that proper performance of the service can be ensured. The owner ensures that all preparations required for completion of the services are finished at the agreed times. This applies in particular to providing access to the home where the services are performed.

2.4 For a recurring schedule, the owner and sitter agree a repeated pattern, including the service, pets, days, times, duration, price per session, billing cycle and start date. Petbnb only generates concrete sessions within a paid billing cycle. A recurring schedule is not an unlimited commitment to future performance without payment.

2.5 Changes to days, times, duration, pets, price, payment method or end date only apply when processed through Petbnb. For active recurring schedules, either party may propose a change; the other party must accept it before it takes effect, unless Petbnb indicates that a change can be processed administratively straight away.

3. Price and payment

3.1 Prior to the services agreed and booked from the sitter, the owner is required to pay the price agreed in the booking via iDEAL to the sitter via the (third-party funds) account holder Stichting Online Betalen, or another party to be designated by Petbnb that Petbnb selects to facilitate payments.

3.2 A recurring schedule is paid in advance by weekly or monthly billing cycle, depending on the option selected in Petbnb. The amount is based on the payable sessions in that cycle plus any applicable fees.

3.3 If payment for a billing cycle cannot be collected or processed on time, the recurring schedule may be placed on payment hold. Future sessions may be blocked and the schedule may be cancelled if payment remains outstanding.

3.4 The owner must pay for the booking in advance through Petbnb. Funds are held by the payment service provider until their scheduled release. Petbnb sets the escrow date when creating the transaction and may subsequently adjust that date while the funds remain held, including to investigate a dispute under the Dispute Mediation section of the General Terms. A change to the escrow date does not reverse a completed payout. The time the money reaches the sitter's bank account also depends on the payment service provider and bank processing.

3.5 The owner and sitter are the parties to the Sitter Agreement and should first try to resolve a booking dispute together. If they cannot, either party may contact Petbnb Customer Support with the booking details and relevant information. Urgent concerns about animal welfare, safety or fraud should be reported immediately. Petbnb's assistance does not make it a party to the Sitter Agreement or the sitter's employer.

3.6 While funds remain held by the payment service provider and intervention is still possible, Petbnb may postpone their scheduled release while assessing a dispute and instruct the provider to release or refund all or part of those funds in accordance with the applicable booking terms and its assessment. A complaint does not automatically stop a payout or guarantee a refund.

3.7 After payout, either party may still request Petbnb's assistance. Petbnb hears both sides and assesses the circumstances. Where it considers a complaint justified, Petbnb contacts the sitter, helps the parties agree a refund and requests repayment from the sitter. Failure to cooperate with resolving a justified complaint may result in the sitter being blocked or removed from the Platform. Petbnb does not guarantee recovery of funds already paid to the sitter or reversal of a completed payout.

3.8 Petbnb's decision concerns the administration of funds still available through the Platform and access to the marketplace. It does not conclusively determine the parties' civil liability or affect their statutory rights, applicable card-dispute rights or access to a competent court or dispute resolution body.

4. Cancellation and termination

4.1 A cancellation policy may apply to certain services. This depends on the type of service and/or the cancellation policy chosen by the sitter. The cancellation terms are stated when the service is booked and/or on the sitter's profile and are binding from confirmation of the Reservation. The Sitter Agreement ends when the entire booking has been completed.

4.2 An individual session in a recurring schedule may be skipped until 21:00 on the day before the session, where Petbnb makes this option available. Skipping one session does not end the recurring schedule.

4.3 A recurring schedule may be put on immediate pause or paused at the end of the billing cycle. A paid current cycle continues when pause takes effect at the end of the cycle. A paused schedule may later be resumed or cancelled if it remains paused for a longer period.

4.4 Where paid sessions are skipped or a billing cycle is closed, Petbnb may process a full or partial refund according to the status of the relevant sessions and billing cycle.

4.5 Petbnb may restrict or terminate access to the Platform following its assessment of complaints, including repeated complaints, or breaches of these Terms. Petbnb considers the circumstances and asks the sitter for their account of the situation. Urgent protective restrictions may be imposed while that assessment is ongoing. Where Petbnb disables and removes a sitter's profile following that assessment, it also cancels and refunds future bookings with that sitter through the Platform.

4.6 The sitter acknowledges that Visa, Mastercard, Worldline as acquirer, or Online Payment Platform (OPP) as Money Fund Distributor may require Petbnb to terminate the sitter's participation in the marketplace immediately if the sitter presents an unacceptable risk or fails to meet applicable contractual standards. Petbnb will comply with a requirement to terminate the sitter's participation immediately and may restrict the account, listing or payment access as necessary to implement it.

4.7 Petbnb provides reasons and information about any available review process as required by applicable law. Information may be withheld only where the law permits or requires this. Restriction or termination of marketplace access does not extinguish obligations arising from existing bookings, refunds or payment disputes and does not restrict mandatory consumer or worker protections.

5. Liability of the sitter

5.1 The sitter is only liable for direct damage resulting from intent or gross negligence on the part of the sitter. Direct damage is understood to mean exclusively: the costs the owner has reasonably had to incur to remedy or eliminate the sitter's failure, as well as reasonable costs to prevent or limit such damage and reasonable costs to determine its cause and extent. Any liability of the sitter, including but not limited to consequential damage, loss of profit and loss of turnover, is excluded. More specifically, the sitter is not liable for damage suffered by the owner that is caused by third parties, whether or not making use of Petbnb. If the sitter is nevertheless liable for any reason, this liability is limited to a maximum of (a) three times the value of the booked service in the relevant case, or (b) € 100, whichever amount is higher.

The owner and the sitter are themselves responsible for taking out insurance against statutory liability and accidents.

6. Applicable law, jurisdiction and language

6.1 Dutch law applies to the Sitter Agreement.

6.2 The working language of this agreement and related negotiations is Dutch.

6.3 In the event of disputes concerning the Sitter Agreement or these General Terms, the owner has access to the ordinary courts.

6.4 In so far as a Sitter Agreement of longer duration is involved, Petbnb reserves the right to amend these General Terms of the Sitter Agreement at any time. The amended terms will be communicated to the owner and the sitter by email no later than two weeks before they take effect, together with information on the option to object. If the owner and/or the sitter do not object to the validity of the new General Terms within two weeks of receipt of the email, the amendments to the General Terms are deemed to have been agreed.
